According to Law360, plaintiff Jennifer Hyatt continued to experience overheating issues after replacing multiple Pixel 6 Pro phones, claiming that the model had a design flaw.

Hyatt believes Google was aware of the flaw, pointing to an article on Google's official website about preventing Pixel phones from overheating as evidence. She said that Google, knowing that the phone was defective, did not issue any warning to consumers, but deliberately concealed the problem in its promotion.

Hyatt asked Google to take the following actions:

  1. Issue an announcement to alert Pixel 6 Pro users to the overheating issue.
  2. Recalling all Pixel 6 Pro phones.
  3. Provide refunds to users who purchased this model.

Hyatt hopes to defend the rights of all consumers who have purchased Pixel 6 Pro in California, accusing Google of violating California’s Consumer Legal Remedies Act, False Advertising Law, Anti-Unfair Competition Law and Song- Beverly Consumer Guarantees Act.

It is unclear whether the lawsuit will eventually go to trial. IT House noticed that last year another user also filed a lawsuit against Google for misleading publicity about the charging speed of the Pixel 6 series.

While Google has always been committed to making quality smartphones, the Pixel 6 series does have some issues. While it might be an exaggeration to say that all Pro models have overheating flaws, perhaps Google could be more responsible in handling the issue.
